Litigation is a huge legal field. Moreover, depending on the kind of the firm, the job description of a litigator can vary widely. However, in general, litigation is the process of representing plaintiffs and defendants in civil cases. The Litigator is therefore, in charge of managing all phases of the litigation process.
Becoming a litigator, there are several levels of education through which one is supposed to go through. First, the particular individual interested in being a litigator should earn a four-year bachelor’s degree from an accredited institution. A courses in English, History, Political Science, and Calculus or any other form of Mathematics is an added advantage. After attaining the degree, enroll in a Law school accredited by the Bar. In this school, for individuals aspiring to become commercial litigators, courses in criminal law, the law of torts, contracts, Lawsuits, corporations, evidence among many others are paramount.
Additionally, the individual should participate in events that give them a real life experience to the practice of litigation. They should be involved in mock trials, moot court competitions and live-client law clinics which enable the individual to have hands on experience. After getting adequate exposure, an aspiring litigator may not practice law before being licensed. Getting a practicing license ensures that the lawyer has attained the required standards before representing a client in a real life situation. Finally, after getting licensed, an individual is now qualified and can seek employment in any firm.
The process of litigation also varies depending on the type of civil case. The comprehensive process, however, starts with the writing of summons and statement claims, then making a formal appearance in court, declaration of the defense, counterclaim, defense to counterclaim, third party claim, and discovery of documents. A trial date is set followed by a pretrial conference. The trial comes followed by judgment, execution of judgment and finally the settlement.
